La usucapión contra registro supone debilitar la fuerza de la inscripción. Implica que el ocupante de un terreno que cumpla con las condiciones para prescribir adquiera dicho terreno por el paso del tiempo, aunque dicho terreno esté inscrito a favor del titular en el registro. Permitir la usucapión contra registro afectaría la seguridad jurídica, al derecho inscrito no ser imprescriptible y perder el propietario su derecho debido a una ocupación de un tercero. Si bien dicho tercero cumpliera con las condiciones del artículo 2229 del Código Civil, admitir la usucapión contra registro equivaldría a socavar los cimientos del sistema inmobiliario registral dominicano, que está cimentado sobre la garantía que otorga el Estado a los derechos inscritos.
